Breach of contract occurs when one party to a binding contract violates the terms of the contract. For example, if the contract states that one of the parties will paint a house white, but instead the driveway is painted green, this will likely constitute a breach of contract. There is a concept in certain types of contracts known as “Material Breach.” Material breach stands for the notion that a breach of contact might not be so severe that it warrants damages. Going back to our painting example, if the contract states that the house should be painted “eggshell white”, but instead is painted “vanilla white” and the difference between the colors is not that noticeable, this may not be a “material breach” of contract.
